As of 23 June 2025, NHS England no longer accepts new applications for distance selling pharmacy (DSP) contracts. This route to market entry has now closed, in the same way the 100-hour exemption previously closed. Existing DSPs remain on the pharmaceutical list and can continue to operate, relocate or change ownership. Private distance selling pharmacies (not providing NHS services) can still be established. Yes. Existing DSPs that are already on the pharmaceutical list can apply to relocate their premises in the same way as other NHS pharmacies. The change of site process applies. TI Pharmacy Consultancy manages relocation applications for existing DSPs.

Yes. Change of ownership applications for existing DSPs follow the same process as for other NHS pharmacies. The new owner must satisfy the ICB's fitness requirements. TI Pharmacy Consultancy manages change of ownership applications for DSP contractors.

Distance selling premises are subject to specific restrictions under the regulations — they cannot provide face-to-face services to patients attending the premises in the same way as a standard community pharmacy. If you are an existing DSP operator and are uncertain about your compliance obligations, TI Pharmacy Consultancy can advise.

Private distance selling pharmacies — those not providing NHS pharmaceutical services — are not subject to the NHS market entry regulations. They must however be registered with the GPhC and comply with all relevant medicines legislation and regulatory requirements.
